Abstract

This study aims to conduct a juridical analysis of state sovereignty and jurisdiction concerning the implementation of diplomatic immunity in the context of the Russia–Ukraine conflict from the perspective of international law. The armed conflict between Russia and Ukraine has generated significant implications for international law, particularly with regard to the protection of diplomatic relations, the application of diplomatic immunities, and the authority of states to exercise jurisdiction over foreign diplomats and state representatives. This research employs a normative legal research method using both statutory and conceptual approaches. The analysis is based on the Vienna Convention on Diplomatic Relations of 1961, the Charter of the United Nations, and various scholarly works and academic journals addressing the Russia–Ukraine conflict. The findings indicate that the principle of diplomatic immunity remains applicable and must be respected even during periods of international armed conflict. Receiving states are prohibited from undertaking measures that contravene diplomatic immunities, as such actions would violate established principles of international law and potentially undermine the stability of interstate relations. Furthermore, the Russia–Ukraine conflict demonstrates several challenges in the implementation of international law, particularly concerning the protection and security of diplomatic personnel, the neutrality of third states, and the effectiveness of international dispute-settlement mechanisms. Therefore, strengthening international cooperation and enhancing the enforcement of international legal norms are essential to ensuring the continued protection of diplomatic missions and personnel amid contemporary global conflicts.
