A LEGAL ANALYSIS OF THE ABUSE OF DIPLOMATIC IMMUNITY AND ITS IMPLICATIONS FOR INTERNATIONAL LAW

Abstract
Diplomatic immunity is an international legal mechanism that grants protection to diplomats from the criminal, civil, and administrative jurisdiction of the host state, as regulated under the 1961 Vienna Convention on Diplomatic Relations. Although this immunity is theoretically designed to facilitate the effective performance of diplomatic functions grounded in functional necessity, in practice it is frequently misused to evade legal accountability for criminal acts, human rights violations, and other unlawful conduct. This study employs a normative legal research framework with a qualitative descriptive approach through the analysis of statutes, international treaties, and relevant legal scholarship. The findings indicate that the abuse of diplomatic immunity results in injustice for victims, undermines bilateral relations, and creates tension between national and international legal systems. Existing mechanisms such as the declaration of persona non grata under Article 9 of the Vienna Convention, waiver of immunity, and the principle of reciprocity have proven insufficient to address serious cases effectively. This study concludes that there is a crucial need to harmonize international and national legal frameworks, strengthen diplomatic oversight mechanisms, and establish a clearer accountability structure in order to maintain a balance between diplomatic protection and the principle of universal justice.
