Abstract

This study examines the juridical implications of Constitutional Court decisions on the transformation of Indonesia’s electoral and regional election regimes. Using a normative legal research method, the analysis focuses on constitutional interpretation, statutory review, and judicial doctrine to assess how key Constitutional Court rulings have reshaped electoral law, institutional authority, and democratic practice. The research highlights three landmark decisions: Constitutional Court Decision No. 14/PUU-XI/2013 on simultaneous elections, Decision No. 97/PUU-XI/2013 on regional election disputes, and Decision No. 53/PUU-XV/2017 on the presidential nomination threshold. These rulings demonstrate that the Constitutional Court functions not only as a dispute resolver but also as a central architect of Indonesia’s electoral system. The Court’s decisions have altered the structure and hierarchy of electoral norms, redefined the relationship between national elections and regional elections, strengthened judicial standards for electoral justice, and reallocated authority among the legislature, election management bodies, and the judiciary. The findings show that Constitutional Court jurisprudence has significant political, administrative, and institutional consequences, influencing party competition, electoral governance, and the stability of the presidential system. Overall, the study underscores the growing role of constitutional adjudication in directing electoral reform and consolidating democratic governance in Indonesia.
